KUALA LUMPUR – A 40-year-old unemployed man has been sentenced to 30 years in prison and 13 strokes of the cane by the Shah Alam High Court on Friday, after pleading guilty to the sexual abuse and murder of his wife’s nine-month-old foster child, four years ago.
Mohamed Badruldin Mohamed received the sentence after admitting to two charges read before Judge Datuk Aslam Zainuddin, Sinar Harian reported.
For the sexual assault charge, he was sentenced to 10 years in prison and one stroke of the cane, while the murder charge carried a 30-year sentence and 12 strokes.
The court ordered that the sentences be served concurrently, beginning from his arrest on April 29, 2021.
According to the case facts, DNA samples and semen extracts belonging to the accused were found in the infant’s anus and colon. A post-mortem conducted by forensic expert Dr Rohayu Shahar Adnan at the Sungai Buloh Hospital confirmed the presence of blunt force trauma injuries to the victim’s anus.
“The cause of death was smothering. DNA samples also confirmed the presence of sperm cells from the accused in the victim’s anus and rectum. The accused was found to have committed unnatural sex. Additionally, there were tears and bruising consistent with fingers or a penis, further substantiating the sexual abuse claims,” the case facts revealed.
On the day of the incident, the victim’s caretaker, Norhidayah Ab Hamid, informed the child’s mother, Robiatul’ Adawiah Aziz, that her son had been taken to the Sungai Buloh Hospital after being found unconscious.
At 7 p.m., a team of doctors and nurses performed Cardiopulmonary Resuscitation (CPR), administered respiratory support, and four types of cardiac medication to stabilise his blood pressure. However, the victim was pronounced dead at 12:18 p.m. on April 28, 2021.
According to the charges, the accused was alleged to have murdered the infant at a flat in the Lembah Subang People’s Housing Project between 8 a.m. and 3:30 p.m. on April 27, 2021. He was charged under Section 302 of the Penal Code, which carries a mandatory death sentence upon conviction.
As for the charge of committing unnatural sexual acts on the victim, the accused pleaded not guilty. The offence, committed at the same location, time, and date, was charged under Section 377C of the Penal Code, which carries a prison sentence of between five and 20 years.
The prosecution was handled by Deputy Public Prosecutor Shahrul Ekhsan Hasim, while the defence was represented by lawyer Azizul Shariman.
During proceedings, Shahrul Ekhsan urged the court to impose the death penalty, arguing that the victim, a helpless infant, had been subjected to such abuse by an adult. “The victim’s parents, who had to work, entrusted their child to Mohamed Badruldin’s wife, only for the infant to be treated in this way due to the accused’s greed,” he stated. “The child was weak and should have been loved and cared for.”
On May 12, 2021, the accused was formally charged at the Petaling Jaya Magistrate’s Court before Magistrate Muhammad Iskandar Zainol. – November 24, 2025
