Three ex-PAS assemblymen challenge Perlis Speaker’s vacancy declaration

They file suit against the Speaker over the unexpected seat vacancies

KUALA LUMPUR – Three former PAS state assemblymen have filed a legal suit against the Speaker of the Perlis State Assembly, Rus’sele Eizan, contesting the declaration of unexpected vacancies for their seats.

The three individuals—Mohd Ridzuan Hashim, former assemblyman for Guar Sanji, Fakhrul Anwar Ismail of Bintong, and Saad Seman from Chuping—filed the case today at the High Court in Kangar. The Speaker and the Perlis State Assembly are named as the first and second defendants, respectively.

In a joint statement issued today, the three former assemblymen expressed their respect for the Speaker’s views but strongly disagreed with his decision. They described the declaration of vacancies as “erroneous and out of order.”

“We have filed this suit to request the court to annul the Speaker’s declaration,” the trio stated. “This action is also for the well-being and interests of the people, who will be left without a representative for up to two years before the next state election.”

They are represented by lawyer Mohd. Jamil Yaacob.

On December 24, PAS announced the immediate expulsion of the three assemblymen from the party. PAS president, Tan Sri Abdul Hadi Awang, stated that the decision was made by the party’s central working committee.

Following this, Speaker Rus’sele declared the three seats—Guar Sanji, Bintong, and Chuping—vacant, informing the Election Commission (EC) of the vacancies.

However, on Wednesday, Rus’sele confirmed that the notification regarding the need for by-elections in these constituencies had been withdrawn. He explained that the decision was based on a proviso to Clause (5) of Article 55 of the Perlis State Constitution and had been communicated to the Perlis EC. – January 2, 2026
