KUALA LUMPUR — Malaysian Border Control and Protection Agency (AKPS) director-general Datuk Seri Mohd Shuhaily Mohd Zain is heading back to the police force following an abrupt end to his secondment, the government confirmed today.

Home Minister Datuk Seri Saifuddin Nasution Ismail revealed that the decision to recall the top cop was finalized last week.

“The decision to return him from his seconded post at the Malaysian Border Control and Protection Agency back to the police force has already been made,” he told reporters after the ministry’s monthly assembly here today.

The minister’s confirmation follows remarks by Inspector-General of Police Tan Sri Mohd Khalid Ismail yesterday, who stated that Shuhaily’s operational status at MCBA had been referred to the Attorney-General’s Chambers (AGC) for legal vetting before being submitted to the Yang di-Pertuan Agong for royal assent.

The matter has also been escalated to the Police Force Commission (SPP) for follow-up action.

Mohd Khalid explained that legal scrutiny was necessary because Shuhaily’s deployment to the border agency was structured as a royal-assented, two-year cadre secondment contract from the Royal Malaysia Police (PDRM).

“We referred this matter to the AGC because Datuk Seri Mohd Shuhaily’s deployment at MCBA is for a two-year period,” the top cop said.

“It is like a contract, and this contract received the royal assent of the Yang di-Pertuan Agong.

“Therefore, should anything arise involving suspension of duties and the like, our subsequent actions will depend on the AGC’s advice. But whatever the case, the matter must be presented to the Yang di-Pertuan Agong regarding contract termination and other related procedures,” he added, speaking on the sidelines of the National Conference on Bureaucratic Red Tape Reform 2026.

On Oct 21, Mohd Shuhaily pleaded not guilty at the Sepang Magistrate’s Court to two charges of voluntarily causing hurt to police personnel Faiz Saman and Ekmal Sofwan Dirman at Kuala Lumpur International Airport on Sept 28.

The court set Nov 25 for mention of the case and the submission of documents. – October 29, 2026
