Zakir Naik will not be extradited to India: Home Ministry

Putrajaya says its position is guided by provisions in the bilateral extradition treaty and Malaysian law

KUALA LUMPUR – Malaysia has decided against extraditing controversial preacher Dr Zakir Naik to India and has made no commitment to hand him over to Indian authorities, the Dewan Rakyat was told today.

The Home Ministry said the decision was made in accordance with Malaysia’s rights under Article 6 of the Extradition Treaty signed between Malaysia and India in 2010, as well as provisions under the Extradition Act 1992, Bernama reported.

It added that no fresh extradition requests had been received from the Indian government.

“An official request for Dr Zakir Naik’s extradition was previously received from the Indian government on Jan 19, 2018.

“The government also received a diplomatic note seeking reconsideration on May 29, 2020,” the ministry said in a written parliamentary reply.

The response was to a question from Datuk Dr Ahmad Marzuk Shaary (PN-Pengkalan Chepa), who sought clarification on the status of India’s extradition request, including the date of its latest official submission.

Ahmad Marzuk also asked whether the documents and evidence provided by India fulfilled the requirements stipulated under the Extradition Act 1992 and the bilateral treaty.

Zakir is wanted by Indian authorities in connection with several cases in his home country. – November 3, 2026
