Freeze first, charge later: Ahmad Zahid unveils aggressive legal hammer against cyber fraud

Clause 54 of the Cyber Crime Bill 2026 arms authorities with swift injunction powers to cut off illicit cash flows before fraudsters can siphon them out of reach

KUALA LUMPUR — In a major escalation against the country’s spiraling online fraud syndicates, Malaysian courts will soon wield the power to freeze scam proceeds and lock down criminal assets before suspects are even formally charged.

The preemptive strike mechanism is embedded in the landmark Cyber Crime Bill 2026, crafted to plug critical loopholes exploited by criminal networks that quickly launder illicit funds through digital channels before law enforcement can file charges.

Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi revealed that Clause 54 of the bill authorizes judicial benches to execute rapid-fire intervention orders to safeguard victims and halt ongoing digital operations in their tracks.

“Among the orders that can be issued include cessation orders, restitution orders to victims, compliance orders, and property restriction orders to prevent assets such as scam proceeds from being dissipated,” Ahmad Zahid stated in a written reply to the Dewan Rakyat.

Under the new statutory framework, urgent restriction applications can be launched directly by the Public Prosecutor or designated enforcement officers the moment suspicious activities are flagged. Crucially, the inclusion of restitution orders equips the courts to force syndicates to return stolen funds straight back to defrauded victims, bypassing prolonged civil recovery battles.

The bill, cleared by Parliament in July, was engineered to counter sophisticated syndicates leveraging artificial intelligence (AI), high-tech identity theft, deepfake impersonations, and systemic digital manipulation.

Ahmad Zahid was responding to BN-Jempol MP Datuk Shamshulkahar Mohd Deli, who pressed the government on whether Malaysia’s existing penal arsenal was equipped to dismantle fast-evolving, AI-powered fraud rings and shield the public from devastating financial strikes. – November 5, 2026
