KUALA LUMPUR – The High Court today directed MYAirline Sdn Bhd co-founder Datuk Allan Goh Hwan Hua and four companies associated with him to return more than RM8 million to 15 investors, after failing to pay monthly redemptions and investment returns.
Judge Leong Wai Hong made the ruling after the plaintiffs, the investors, successfully proved their claims against Goh and the four companies on a balance of probabilities, Bernama reported.
“The court orders the defendants to repay RM7.61 million and SGD170,000 to the investors,” the judge said.
Additionally, the court ordered that costs of RM100,000 be paid jointly or separately by Goh and the other defendants, including I-Serve Online Mall Sdn Bhd (ISOM), Bright Moon Venture PLT (BMV), QA Smart Partnership PLT (QAS), and Trillion Cove Holdings Bhd (TCH).
In a writ of summons and statement of claim dated July 21, 2022, the plaintiffs alleged that the defendants failed to make payments from November 2021 to June 2022, despite having sent demand letters through their lawyers.
The plaintiffs, aged between 58 and 74, named Goh as the co-founder and majority shareholder of MYAirline Sdn Bhd, and accused the four companies of breaching their fiduciary duties, holding them personally responsible for the losses suffered by the investors.
The plaintiffs also claimed that Goh, in various notices, instructions, and teleconferences, assured that issues faced by ISOM would not affect the investors’ monthly returns. Furthermore, they alleged that ISOM, TCH, and the other companies involved were raided by Bank Negara on November 11, 2021, and a freezing order was imposed on all the companies.
As a result, the plaintiffs sought, among other things, a refund of RM8 million in subscription fees, overdue redemption payments, and an annual interest of 5% on any judgment sum awarded. – September 9, 2025
