KUALA LUMPUR – The Health Ministry (MOH) has taken swift action against one of its employees after they were caught smoking at a food premise in Rawang.
An immediate investigation identified the individual as a civil servant from the Gombak District Health Office (PKD). The incident came to light following a social media post on March 23 that showed the staff member violating public health regulations.
“No one is above the law, including MOH staff who should be role models for the community,” Health Minister Datuk Seri Dr Dzulkefly Ahmad said on X.
“I have directed that firm and immediate action be taken. The individual involved has been compounded under Act 852 and will face disciplinary action.”
The compound was issued under Section 16(2) of the Control of Tobacco Products for Public Health Act 2024 (Act 852), which explicitly bans smoking in food premises.
In addition to the fine, the staff member faces internal disciplinary proceedings under the Public Officers (Conduct and Discipline) Regulations 1993 to uphold the integrity of the civil service.
MOH emphasised that food premises are among 28 designated non-smoking areas set up to safeguard public welfare.
“As the lead agency for public health, the ministry will not compromise with any staff members who fail to comply with established laws,” the ministry said in a statement.
Dzulkefly and the ministry also expressed gratitude for public vigilance and encouraged the community to continue reporting violations through official channels to strengthen enforcement and protect public health. – March 24, 2026
