KUALA LUMPUR — A trader pleaded not guilty at the Sessions Court here today to a charge of making and initiating an offensive social media communication two years ago.
Sanuzi Kernain, 42, entered the plea after the charge was read before Judge Ahmad Fuad Othman.
According to the charge sheet, Sanuzi was accused of making and initiating the communication with the intention of hurting others via Instagram through the account “boss.s_k” on November 13, 2024.
The post was later detected at the Malaysian Communications and Multimedia Commission (MCMC) Tower 1 in Cyberjaya at 5.15am on February 21, 2025.
The charge was framed under Section 233(1)(a) of the Communications and Multimedia Act 1998, punishable under Section 233(3) of the same Act.
If convicted, the accused faces a maximum fine of RM50,000, imprisonment of up to one year, or both, as well as an additional fine of RM1,000 for each day the offence continues after conviction.
MCMC prosecuting officer Nazrul Nizam Mohd Zameri proposed bail at RM10,000 with one surety. However, defence counsel Badrul Mushani Mustapa Albakari, who represented the accused, appealed for a lower amount, citing that his client is self-employed and plans to start a small-scale business soon.
The court allowed bail of RM8,000 with one surety and fixed May 5 for case mention. – April 7, 2026
