KUALA LUMPUR – The application for the discharge not amounting to acquittal (DNAA) for criminal charges against Deputy Prime Minister Datuk Seri Ahmad Zahid Hamidi was made to the court for reasons that were accepted by the High Court, the Attorney General’s Chambers (AGC) said.
“In making this decision, the honourable judge stated that the reasons presented by the prosecution are cogent,” the AGC said in a brief statement issued tonight.
The AGC had made the statement in response to media reports which had carried comments that described the DNAA as “immoral”.
Earlier today, former prime minister Tan Sri Muhyiddin Yassin referred to Malaysia as “a rogue state” in light of the controversial decision by the Attorney General (AG) to withdraw all 47 criminal charges against Zahid, who is also Umno president.
Muhyiddin criticised the AG’s use of powers under Article 145(3) of the federal constitution, describing the move as “immoral”
Justice Datuk Collin Lawrence Sequerah granted Zahid a discharge not amounting to acquittal on all 47 of his criminal breach of trust, corruption, and money laundering charges related to funds belonging to Yayasan Akalbudi, following the prosecution’s decision to halt proceedings for a more thorough investigation.
This decision has sparked strong criticism from political parties, legal figures, civil society, and the public.
Muhyiddin highlighted the significant progress made in the case against Zahid, with the prosecution successfully establishing a prima facie case, supported by documentary evidence and 99 witnesses.
Muhyiddin also expressed concerns about the implications of this decision and raised questions about the possibility of higher authorities ordering the abandonment of the case at any cost.
The Pagoh MP did not hold back when he squarely blamed Prime Minister Datuk Seri Anwar Ibrahim, accusing him of a relentless pursuit of power.
Muhyiddin also pointed out that the repercussions of this decision have extended beyond Malaysia’s domestic sphere, causing concern among the global business community. – September 5, 2023
