KUALA LUMPUR – Malaysian Bar president Mohamad Ezri Abdul Wahab said authorities must respect the legal professional privilege and the right to representation for individuals, following the arrests made by the Malaysian Anti-Corruption Commission (MACC) on two lawyers.
He also reminded lawyers of the critical importance of attorney-client privilege, saying that if authorities seek confidential documents from their clients, Bar members are obligated to refuse disclosure until their client’s written consent is obtained.
He also urged lawyers to avoid unethical and dishonest practices that could undermine public trust and confidence in the legal profession.
Ezri mentioned that legal professional privilege allows individuals to access legal advice without reprisal or breach of confidentiality, and by respecting such principles, authorities can reinforce the integrity and credibility of their investigative processes.
“We urge all enforcement bodies to cease unlawful practices that undermine legal professional privilege and the right to legal representation.
“It is imperative to respect these legal rights and privileges, as they are fundamental to the proper administration of justice,” Ezri said in a statement.
Today, Lawyers for Liberty condemned the MACC’s investigations over the alleged misappropriation of funds by two lawyers, Lai Chee Hoe and Irwin Lo.
According to Lai, on June 4, MACC officers visited his office and requested documents related to a client’s property dispute civil case.
He was then taken to the MACC’s headquarters and arrested around midnight, leading to his detention until June 6.
Lai said the MACC had released him on June 6 – but on three conditions, including withdrawing himself from the civil case or not appearing in any press conference and talking about the incident.
In response, MACC denied the allegations, saying that the investigation was conducted properly and was related to suspected embezzlement and power abuse. – June 11, 2024
